THE NEGOTIATION OF
GARUDA INDONESIA CABIN CREW COLLECTIVE AGREEMENT


The Report in details


01.
The Cabin Crew Collective Agreement (PKAK) is the inseparable part of The Garuda Indonesia Collective Agreement (PKB). As Stated on Indonesian Government Act no. 13/2003 about the man power and labor, article 116, 119 and 120 thus we did the coalitions (to fulfill the requirement of the Government Act) between SEKARGA (Garuda Indonesia Employee Union) and IKAGI (Garuda Indonesia Cabin Crew Union), in mid year of 2006. After the coalitions, then the negotiation to pro long the Garuda Indonesia Collective Agreement (known as PKB) begin.

The first process is to arrange the agreement of general rule of the negotiation which took two times of meeting then continue arranged the contents of the Collective Agreement. This is the hardest part since the process not through smoothly due to the different point of view between Garuda Indonesia management and the Union, even worse the management personnel need the letter from CEO as ‘on behalf’ from time to time to establish the meeting. The most important thing to share is that the negotiations started BUT to be truthful, it was then not the smooth one as we expected due to the hectic schedule of the Management of Garuda Indonesia. Thus, in the beginning of year of 2008, both Management of Garuda Indonesia and The Union held the negotiations in marathon in several cities outside the Java Island to run the meeting in order to make the negotiations as effective as possible.

April 14, 2008 is marked as the FIRST in the Garuda Indonesia Cabin Crew history ever since the negotiation of the Cabin Crew Collective Agreement begins in definitely. The team from IKAGI as listed: Mr. Zainudin Malik, Ms. Dewi Anggraeni, Mr. Rudi Priyanto, Ms. Christine Ekel, Ms. Brahmanie, Mr. Ahmad Muzhar, Mr. Raden Jorry, Mr. Supri Seswodahono, Mr. Ary Kurniawan, Mr. Aji Setiawan, and Ms. Dewi Handayani. From Those 11 members listed as IKAGI team, 2 of them were placed on the Garuda Indonesia Collective Agreement negotiation and the others 9 were placed on specified Garuda Indonesia Cabin Crew Collective Agreement negotiation. The First negotiation commenced from April 14 until April 18 2008 (Five times meeting) held at Hotel Alila Pecenongan, Jakarta. In these meeting IKAGI proposed 77 articles, and 436 parts, started from the contents of General Rule then the Amendments, meanwhile the management offered 16 articles. In General, the April Meeting results is as listed: Both management and IKAGI team agreed on The Cabin Crew Competency Certificate, The Plan and recruiting methods for Cabin Crew, The Outsourced Cabin Crew requirements, and The articles of Education and Development for Cabin Crew.

The Meeting continued on May 13 to May 16, 2008. Then on May 27 to May 30, 2008. These meeting consist of 28 articles (held in Eight times meetings) to be negotiated and some of the materials are stated as pending. The meeting was held at Hotel Red Top, Pecenongan, Jakarta. On the other hand, both side of the teams agreed on these results: The articles of Cabin Crew Scheduling, The articles of Schedule revisions, The articles of the Flying Hours recognition, The Personal Flight Log Book, some parts of the Personal Accident Insurance, The Articles of The Medical Examination, and some parts of The articles of Day Off.

On August 13 to August 15, 2008. Then on August 27 thru August 29, 2008, the meeting continued and held at Hotel Red Top Pecenongan, Jakarta. Consist of 37 articles to be negotiated in Six times meetings. Some of the articles considered as general were transferred to the Garuda Indonesia Collective Agreement and some of those stated as pending. Both side of the team agreed on the listed results: The Foreign Language skill Appreciation, The articles of the Flight and Travel Allowances, The articles of the mean of Cabin Crew Transportation, The articles of Cabin Crew Hotel and Accommodations, The articles of Cabin Crew Uniform and Duty attribute, The articles of Menstrual/Period Leave, The articles of Annual Leave, The articles of pregnancy and baby delivering Leave, The articles of Post Partum, The articles of Union working hours, The articles of Union budgeting and financial plan, and the most important is The articles of Salary. There are some certain conditions about the articles of salary as listed:
a.
The articles of salary consist of 8 parts to be negotiated.
b.
On August 13, 2008, those 8 parts completely finished as planned but only 5 parts agreed to be applied by both teams.
c.
The rest 3 parts are stated as pending parts.
d.
The parts that approved by both teams are as listed: The value of annual increment is 3,5%, Junior rank range span are year 0 to year 10, Senior rank range span: year 0 to year 15, Flight Service Manager rank range span: year 0 to year 15, The maximum salary value (max-flat) is applied, the salary value on lower rank are not higher than the minimum value on higher rank, there are gap among those rank range span.

The management then provided both teams to continue the meetings in their own meeting room on November 10 to November 14, 2008 consist of Five times meetings and 12 articles to be negotiated. Both teams agreed to eliminate two articles, and most of the articles finished as planned. Are as listed: The articles of Cabin Crew Competency, The articles of Cabin Crew Rank structure, The articles of Cabin Crew Instructor, The articles of Cabin Crew performance monitoring system, The articles of performance monitoring tools, The articles of the performance results, The articles of Cabin Crew rank promotion, Some articles of Cabin Crew schedule revision, The articles of Flying Hours Appreciations, The articles of Cabin Crew Personal data.
As the meetings continued, both teams agreed to form the smaller groups of each teams to accelerate the negotiations. From this small teams then concluded some recommendation to be negotiated on the Plenum. The small teams held ten times meetings as on November 17 to 21, 2008 and continued on November 24 to 28, 2008. And other three times meeting on December 19, 22 and 23, 2008. And other Four times meeting on January 15 to 16 and January 19 to 20, 2008.

After the meeting as we explained on item no.6, since November 14, 2008, the negotiations freeze for two months. Then, on February 6, 2009. The meeting continued in Management meeting room for once, discussed and approved the articles of Flight time value. Agreed on five parts out of seven provided, which means the two are stated as pending parts.

Both teams continued the negotiations on month of May 2009, dated 12 to 15, 19 to 20, 22 and 26 to 29. These ten times meetings negotiated 18 articles and attachments. Placed in management meeting room in suite #202. The results are as listed: Disagreed on Cabin Crew working hours limitation and some articles of Stand By and Reserve Duty also the definition of Rest Period. And Agreed on some articles of Cabin crew Insurance, The articles of Cabin Crew Appearance Allowances, parts of condolences allowance, parts of the Cabin crew meal allowances, and the articles of HIV/AIDS. On this occasion, The Cabin Crew team proposed the value of Salary entry point as IDR 6,000,000, the GAP range span as 7% among ranks. The Cabin Crew team (IKAGI) asked and wait for the salary system provided by the management of Garuda Indonesia.

The negotiations then freeze once again (about four months) due to the hectic agenda of management team, and then continued on October 19 to 20, 2009. Held in Hotel Red Top, Pecenongan, Jakarta. The meetings specified to discuss the articles of salary system and the articles of Cabin Crew Union facilities. On this occasion, the management teams offered the value of salary entry point as IDR 2,100,000 concerned as budgeting reason and nothing more.

Ever since the last negotiations ignored to conduct of pro long the year 2004-2006 Collective Agreement validity period since December 2009, and the unfinished negotiations on the articles of Salary system between both teams, again, on January 28, 2010, both teams gathered with the Board of Director of Garuda Indonesia in Garuda Indonesia City, at Center Building. On this moment, the CEO of Garuda Indonesia made a crucial statement: He will raise the salary of every single Garuda Indonesia employee as higher as 50% each. So the negotiation then arranged to be held On February 1 to 6, 2010, took place At Imperial Arya Duta Hotel, Lippo Karawaci, Tangerang. Specifiied on the article of Cabin Crew salary system. In the last three days agreed and approved on results as listed:

a.
The new value of Entry point of Cabin Crew salary system now IDR 2,954,346

b.
The Gap among the rank range span now 6%.
c.
The values of salary listed are added by the 50% as promised and offered.
d.
The formula to measure the Flight Service Manager Active Duty as they perform.
e.
The placement of new hire Cabin Crew salary approved in the year of 2009.

It took almost Four years in a row to make the Cabin Crew Collective Agreement worth, but then again, both team continued the negotiation on March 22, 2010 in order to finish these very important agreement. The meeting started on April 6 to 9, 2010, and April 12 to 16, 2010 in Hotel Red Top, Pecenongan, Jakarta, and on April 28 to 29, 2010 in Hotel Arya Duta, Tugu Tani, Jakarta, which consist of eleven meetings. The first process of the meetings are both teams begin to separate groups of articles and parts in whole page of ‘notulen’ (notes of earlier meetings resume) in two groups, which categorized as stated as agreed and approved and the materials that categorized as never been negotiated or as dead-end. We would let you know that during these process, the management teams are ONLY enclose the ‘notulen’ dated August 13, 2008 and IGNORED the rest! Especially the ‘notulen’ dated February 6, 2010, -which we considered as the most important notes(since its content definitely about the salary system)- none of the management has the good-will to enclose it as we see it fit.
On the next negotiations, dated April 16, 2010, we exchange each other draft of the rest materials, which consist of articles and parts stated as pending. But, until April 29, 2010, those draft has not been negotiated yet or as unfinished. The whole materials also some enclosure and inseparable attachments that related to the main contents of the Cabin Crew Collective Agreement.

The discussion over the Cabin Crew Collective agreement such as definitions, The articles of transferred career, travel allowances attachments, Duty attributes attachments, the articles of Health care, the articles of duty travelling, and some other related articles have been omit or as stated as unapproved. Then on May 3, 2010 held at Hotel Akmani Wahid Hasyim, Jakarta, another negotiation begin. On this day, the whole contents were concluded. Started from chapter by chapter, parts by parts and even so the sub parts. But unfortunately, on May 7, 2010, the whole process seems to be impossible to carry on since the both teams has a very different point of view on the most important content, which is the ‘notulen’ or the notes of the Salary system.

13.
Finally, the Cabin Crew Union team and the Garuda Indonesia management team has concluded that after the end of the compilation process then is considered as the end of the whole negotiation which means no more negotiation whatsoever after this.
The Final results are as listed: Approved and agreed to 48 articles, rejected 7 articles, 246 parts are listed as Approved, and ONE articles stated as UNSTATUS. The whole negotiations consist of 53 (Fifty Three) times in plenums, and 17 (Seventeen) times in small workgroups negotiations.
